Assessing damages after a fatal crash is difficult but possible

Even though we know that everyone dies at some point in their life, the loss of a loved one is rarely an easy thing to deal with. This is especially true when someone dies in a sudden fatal accident. In these instances, family and friends are oftentimes left feeling that their loved one's life was cut short; and the grief they feel, is generally difficult to soothe.

As some of our Indiana readers are well aware, some fatal accidents are the direct result of someone else's negligence, which is considered grounds for a personal injury or wrongful death lawsuit. Depending on the outcome of the civil proceedings, a victim's family may be awarded damages. Let's take a look at what damages can be recovered after a fatal crash.

Economic damages. Perhaps the easiest to assess, economic damages seek to compensate a victim's family for actual damages such as medical bills, damage to property, loss of future wages, and burial costs. These damages are typically considered easy to calculate because the courts can see the actual costs associated with a fatal crash and order compensation accordingly.

Noneconomic damages. A little more difficult to calculate, these damages are based on the pain and suffering a family may experience after the loss of a loved one. Because there is no bill associated with this type of damage, it is up to the courts to decide what is a fair and just amount to give to the victim's family.

Although it may seem difficult to put a dollar amount on a family's pain and suffering, it's not impossible, especially with the help of a skilled lawyer. With an attorney at your side, you can make sure that you are getting the fair compensation you deserve and the closure you need to move on with your life.
