Can a city or county be responsible for a motorcycle accident?

As many people know, not all motorcycle accidents involve other vehicles. Sometimes, accidents happen because of potholes in the road, debris left in the street or other conditions that make the road itself hazardous. So, what happens if you are injured because of poor road conditions? Do you have any options for recourse?

The answer to that question may be "yes," depending on the exact circumstances of your case. If it can be proven that the city or county responsible for maintaining the road you were injured on failed to do so, it may be possible to seek compensation from the municipality.

Suing a city or county, however, is rarely easy. You are often required to adhere to strict processes with strict deadlines. Most injury claims against a government entity begin with filing a notice of claim, which lets the government know that you were injured because of its negligence. At this point, the government can either accept or deny your claim. Most often, claims are denied.

If the government denies your claim, the next step is to file a civil lawsuit. Like in other personal injury cases, you will have to prove that is more likely than not that the government's negligence caused or contributed to your injuries.

Going through this process alone can be intimidating and sometimes confusing, which is why it is often beneficial to work with a motorcycle accident attorney who has experience suing municipalities. An experienced attorney can review the details of your case and help you determine your best approach to seeking compensation for your injuries.
