Alleged drunk driver hits moped, killing 1, injuring another

Motorists in Indiana are considered to be intoxicated if their blood alcohol content is .08 percent or higher. An alleged drunk driver is expected to be arrested upon his release from the hospital after allegedly causing the death of one person and injuries to another while driving with a BAC of .24 percent. Reportedly, this is not the first time that the man has faced accusations of driving while intoxicated.

Police reported that the accident occurred early on a recent morning when a moped, carrying a driver and a passenger, was eastbound on a Muncie road. A 24-year-old driver of a car -- traveling in the same direction -- apparently smashed into the rear of the moped. The impact reportedly caused both the moped riders to be ejected, and they landed on the car's hood, slamming into the windshield.

The car apparently continued driving -- with the moped stuck to its grill -- for a further 500 feet before coming to a halt. The two victims ultimately landed in a ditch. The less severely injured moped passenger apparently attempted to resuscitate the driver, whose injuries were critical. Nevertheless, the 18-year-old moped driver succumbed to head injuries in the hospital later that day. The car driver was transported to the hospital for toxicology tests, but it was later revealed that he was admitted because he was traumatized.

Preliminary charges against the alleged drunk driver include DUI causing death and serious bodily injury. Indiana families who have to cope with the unexpected death of a loved one that was caused by the negligence of another party may pursue financial relief to seek reimbursement of monetary losses, including funeral and burial costs. The surviving family members of a deceased victim retain the right to file a wrongful death claim in a civil court, based upon evidence of negligence on the part of the party or parties sued.
