Signs that a driver was distracted before an accident

It isn't always easy to tell when other drivers around you are engaging in unsafe behaviors. While you can see and avoid speeding drivers who are weaving in and out of traffic, it is much more difficult to see and avoid the driver behind you who is looking down for a few seconds to read a text.

Because we don't always see distracted drivers coming, it can be critical that we look out for evidence of distraction in the aftermath of accidents. Identifying these details can be of critical importance to victims of distracted driving crashes.

Depending on the type of distraction involved, there are several different places to look for indications that a driver was not paying attention.

For instance, if the car swerved into a different lane or onto a sidewalk, that could be an indication of manual distraction. This means the driver's hands were off the wheel. Finding food, drinks, a book or grooming accessories and devices within reach of the driver could indicate that the driver was involved in activities other than driving.

If the driver never slowed down or missed a traffic signal before a crash, it could be a sign that he or she was not looking at the road and was visually distracted. This can happen when people are helping kids in the backseat, trying to enter information into a GPS device or looking at some commotion outside the vehicle.

In many cases, a driver's mind is simply not on driving and they make some basic errors in judgment. This is cognitive distraction and while it can be very difficult to identify, one of the most cognitively distracting behaviors is reading or writing something on the phone. Scrutinizing a driver's phone records can give some insight into whether a driver was focused on something other than the task of driving.

Identifying potential signs of distraction can be enormously difficult for victims to do alone. This is why many accident victims work with a personal injury attorney who knows where to look and what to look for after a crash causing damages. Investigating these details and building a claim can help people pursue the compensation they need and deserve.
