Cargo securement issues can cause truck accidents

It is common to see commercial haulers of all sizes on Indiana roadways. This is both a good and bad thing. It is good in the fact that it means economic improvements have increased consumer demand. It is bad in the fact that these big trucks can be dangerous with which to share the road. Truck accidents occur for various reasons, one of them being issues with cargo.

Have you ever seen a semi tipped on its side or watched as cargo has come spilling off a trailer? It happens more than anyone would like to think, but why?

Cargo securement

Securing cargo properly is necessary in order to protect the loaded products but also to ensure safe transportation. Trucking companies are to abide by strict guidelines set by the federal government when it comes to cargo securement. Current cargo securement rules state that:

  • Cargo is to be secured using approved tie downs
  • Ties are to be attached to proper anchor points
  • The number of ties used will be determined by the weight of the cargo

Weight restrictions

Every truck is different when it comes to how much weight it can carry. It is up to trucking companies and drivers to ensure that their trucks do not carry more than their approved weights.

What happens if an accident happens due to cargo securement or weight issues?

If securement and weight regulations are not followed, cargo can shift during transportation causing truck balance issues, causing loads to fall or causing various other issues that can lead to accidents. If an accident does occur because of unfollowed federal regulations, the driver and trucking company can face significant legal consequences.

Those who have suffered injuries or lost loved ones in truck accidents resulting from cargo issues may have legal recourse. According to the state of Indiana, you may file civil claims against the driver and his or her employer in an effort to seek compensation for any losses you have sustained as a result.

After truck accidents occur, proving negligence can be somewhat challenging -- particularly when regulation compliance issues are being questioned. An experienced attorney will be able to do what is necessary to fully investigate your claims, which may bring information to light that can prove beneficial to your case and help you fight for fair and full compensation.
