How long do I have to file a lawsuit after an accident?

Deadlines are not the first thing that you think about after an accident. After a life altering accident you will be focused on day to day essentials such as healing, eating and resting. If you were in a car accident then you will be thinking about how you will get to work and when you will find a new vehicle. Once you have the important basics sorted out your next step should be to decide if you want to file a personal injury lawsuit.

File on time or get your case dropped

In Indiana the time limit to file your personal injury lawsuit will be the same no matter the cause of injury. Whether the lawsuit is due to a car accident, a fall injury or someone's negligence, you will have a time limit (also known as the statute of limitations). Residents of Indiana have two years to go to court and file a lawsuit.

This means that you will need to file a lawsuit against a particular defendant within two years of the accident. If you miss the deadline then the defendant could ask the court to dismiss your case. Unless there were very special circumstances, the court will likely agree.

Don't miss your window while you wait to heal

It takes time to learn the full extent of an injury. Accident victims will often wait to file a lawsuit while they find out the result of their injuries. This trap can cause victims to miss their window to file. You can file a personal injury lawsuit before you know the extent of your injuries.

Some injuries can linger on and some become permanent. It is important to know how your injuries will affect the rest of your life before you reach a settlement. You can't go back for more money after the court has agreed to a settlement. This is why you will need to make sure you file before the two year deadline, but do not settle until you are ready.
