Debris is the deadly threat that you may not see coming

Many things can cause a car accident, from distracted drivers to dangerous car parts. Road debris is one of these hazards, yet many fail to recognize the distinct danger that it presents to motorists. One of the most common sources of dangerous road debris includes trucks and other vehicles with unsecured loads.

There are laws that protect Indiana drivers from unsecured loads, yet it continues to be a risk for drivers. In fact, it may be the cause of the accident that left you or a loved one injured. If an unsecured load caused you harm, you would be wise to take quick action to ensure that the appropriate parties are accountable and that you obtain the compensation you deserve.

The risk of driving with an unsecured load

There are many reasons why it is simply dangerous to drive with any type of unsecured cargo. From mattresses to construction debris, when something flies out of the back of a truck or other type of vehicle, it is not a danger to that driver, yet it is to all of the innocent drivers and passengers following behind.

Each driver is responsible for ensuring that his or her load is secure and safe for transport. This goes for major trucking companies, commercial drivers and any other person transporting something in the back of his or her vehicle. Some of the ways that unsecured cargo can cause accidents includes the following:

  • Overloaded trucks or trailers
  • Transporting loads without straps, netting, ropes or other apparatus
  • Failure to secure a load to the vehicle itself

When a cargo load travels on a vehicle unsecured, as little as a speed bump or a sudden tap on the brakes can cause things to fly off and land in the road. Even the smallest of objects could cause significant damage or set off a chain of events that could ultimately lead to a serious accident.

What can victims do?

If you are the victim of an accident that was the result of road debris or unsecured cargo, you have options. It is possible to hold the liable parties accountable for what happened to you, but you would be wise to take quick action to protect your interests.

Individuals who suffer because of negligent or reckless actions of another driver or company have the right to seek compensation for their financial losses. If you are unsure of your options or want a better understanding of your rights, you may find it useful to first seek a complete evaluation of your case.
