Hurt on public or private property? Who is to blame?

When you visit a friend's home or take a trip to the grocery store, you have a reasonable expectation that your personal safety is not under threat. However, accidents do happen, circumstances are not always controllable and you could find yourself hurt. If you suffered harm while on public or private property in Indiana, you may be wondering who is to blame.

After a premises liability incident, it could be useful to seek a complete evaluation of your case. In some cases, it is possible to seek and obtain compensation through a civil claim. If you were hurt, it may not be because of your own clumsiness or recklessness, but it could be the result of risks and hazards that were beyond your control.

Where should you place the blame?

Slip-and-fall accidents are one of the most common types of premises liability incidents, but there are many other ways that you could find yourself injured due to unsafe premises. It is possible that the property owner is to blame for the harm you experienced.

Proving liability can be quite complex. A strong liability claim starts by proving sufficient evidence and documentation that proves you are a victim of negligent maintenance or other issue. In order to validate your pursuit of compensation through a premises liability claim, you must be able to prove the following:

  • The property owner or an employee actually caused the dangerous condition that led to your accident.
  • There was enough time for a property owner or an employee to learn about and fix the problem.
  • The property owner or an employee knew of the existence of a dangerous property condition but did not fix it.

Property owners have the responsibility to address and fix issues and hazards that could cause harm to people who visit the property. If you believe that you may have a case, you would be wise to act quickly to preserve your rights and any evidence needed to build a strong claim.

Getting better after an accident

A premises liability incident may not always seem that serious, but even a minor incident can lead to serious pain, lingering complications and more. If the circumstances that led to your accident were the result of the negligence of a property owner, you do not have to stay silent.

You have the right to get better, as well as the right to claim the restitution you need for medical care, rehabilitation and other accident-related expenses.
